1. About these terms

These Terms & Conditions govern your use of https://shop.aljarash.com/ and any purchase you make from Aljarash Home Co., owned and operated by Linda Miller at 368 Pennsylvania Avenue, Helena, Montana 59620, USA. By using the site or placing an order you accept these terms. If you do not accept them, please do not use the site.

2. Who may buy

You must be at least 18 years old and able to form a binding contract, and you must provide a delivery address within the United States or an APO/FPO address. We may decline or cancel any order at our discretion, for example where we suspect fraud, where an item is mispriced, or where an address cannot be verified.

3. Products, descriptions and images

We describe every item as accurately as we can, including materials, dimensions and care requirements. Natural materials such as wood, stone, linen and reactive-glaze ceramic vary in grain, tone and texture from piece to piece; this variation is a characteristic of the material and not a defect. Screen colour rendering also differs between devices. If a delivered item differs materially from its description, it is covered by our Returns & Refunds policy.

4. Prices

All prices are in United States dollars and exclude shipping and any applicable sales tax, both of which are shown on your written order summary before payment. We may change prices at any time, but never after you have approved an order summary. If a product is listed at an obviously incorrect price due to a typographical or system error, we will contact you and offer to cancel or re-confirm at the correct price rather than silently charging you.

5. Orders and contract formation

Browsing the catalog and requesting a quote does not create a contract. A contract is formed only when we send you a written order confirmation after payment has been authorised. Until that point either party may walk away without cost.

6. Payment

We accept Visa, Mastercard, American Express and Discover through a PCI-DSS compliant payment processor. Payment is taken in full at the point of order confirmation. You warrant that you are authorised to use the payment method presented.

7. Delivery and risk

Delivery estimates are given in good faith but are not guaranteed, because transit is performed by third-party carriers. Risk of loss or damage passes to you on delivery to the address you supplied. Our Shipping page sets out costs, timescales and what happens if a parcel is delayed, lost or damaged.

8. Returns and cancellation

Your rights to return goods and receive a refund are set out in full in our Returns & Refunds policy, which forms part of these terms. Nothing in these terms limits any statutory right you have under applicable consumer protection law.

9. Warranty and limitation of liability

We warrant that goods will be free from manufacturing defects for 12 months from delivery under normal domestic use. Except for that warranty and any rights you have under mandatory consumer law, products are supplied “as is”. To the fullest extent permitted by law, our total liability arising out of or relating to any order is limited to the amount you paid for the relevant goods, and we are not liable for indirect, incidental, special or consequential losses. Nothing in these terms excludes liability for death or personal injury caused by our negligence, or for fraud.

10. Acceptable use of this website

• Do not attempt to gain unauthorised access to the site, its server or any connected system.
• Do not scrape, mirror or republish substantial parts of the site without our written permission.
• Do not introduce malware, run automated attacks or interfere with other users' access.
• Do not submit unlawful, defamatory or infringing content through our contact form.

11. Intellectual property

All text, photography, product descriptions, layout, the Aljarash Home Co. name and the logo are owned by Aljarash Home Co. or licensed to us, and are protected by United States copyright and trademark law. You may view, download and print pages for your own non-commercial use only. Commercial reuse requires written permission — write to Linda and we are usually happy to help.

12. Third-party links

Where we link to another website we do so for convenience and information. We do not control those sites and are not responsible for their content, products or privacy practices.

13. Privacy

Our handling of personal data is described in the Privacy Policy and the Cookie Policy, both of which form part of these terms.

14. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including severe weather, carrier disruption, utility or network failure, fire, flood, civil disturbance or acts of government.

15. Complaints and dispute resolution

If something goes wrong, contact us first — the overwhelming majority of issues are resolved on the phone the same day. Email Linda@shop.aljarash.com with the heading “Complaint” and we will acknowledge within one business day and give a substantive answer within ten.

16. Governing law

These terms are governed by the laws of the State of Montana and the applicable federal laws of the United States. The state and federal courts located in Lewis and Clark County, Montana have exclusive jurisdiction, without limiting any right you have to bring a claim in your own jurisdiction where consumer law requires it.

17. Severability and changes

If any provision is found unenforceable, the remainder stays in force. We may update these terms; the version in force is the one published on this page at the moment you place an order.
